These Terms of Service ("Terms") govern your use of the krawl website (https://krawl.dk/) and related services, including our mobile applications (together, the "Services"). By accessing or using the Services you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree with any part of these Terms, you may not use the Services.

Controllers: krawl's Services are operated by krawl; an independent voluntary association (da: Frivillig forening). The board of krawl act as data controllers for personal information processed through the Services.

1. Eligibility

The Services are intended for users who are at least 18 years old. By using the Services, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into these Terms.

2. Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use.

3. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

• Violate any applicable law or regulation;
• Infringe the rights of others, including intellectual property rights;
• Transmit any harmful content, such as malware or spam;
• Attempt to gain unauthorized access to the Services or related systems;
• Interfere with or disrupt the operation of the Services.

We reserve the right to suspend or terminate your access if you breach these Terms or engage in prohibited conduct.

4. Intellectual Property

The Services and all content, features, and functionality therein are and will remain the exclusive property of krawl and its licensors. The Services are protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

5. Third-Party Content and Links

The Services may contain links to third-party websites, services, or apps that are not owned or controlled by krawl. We are not responsible for the content or practices of any third-party sites. Your interactions with any third-party sites are solely between you and the third party.

6. Privacy and Cookies

Our collection and use of personal information are governed by our Privacy Policy, and our use of cookies is described in our Cookie Policy. By using the Services, you consent to such practices.

Location features (app only). If you enable location services in the app, your location may be stored and shared with other users who are in the same krawl and have the krawl code, to provide night overview and friend location features.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be available at all times or error-free.

8. Limitation of Liability

krawl's members and contributors are not liable for any damages arising out of or inlating to your use of the Services. The legal responsibility of krawl's Services is limited to the krawl association itself, and not to any individual member or contributor.

krawl's liability is limited to the maximum extent permitted by applicable law, the service is provided “as is” and krawl shall not be liable for any indirect, incidental, special, or consequential damages.

krawl does not promote excessive alcohol consumption or irresponsible behavior. Users are expected to use the Services responsibly and in accordance with local laws and regulations. krawl is not liable for any consequences resulting from actions with a relation to the use of our Services.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in courts located in Denmark. You agree to submit to the personal jurisdiction of these courts.

10. Changes to Terms

We may modify these Terms from time to time. The "Last updated" date at the top will reflect when changes occur. Continued use of the Services after changes constitute acceptance of the new Terms. If we make material changes, we may provide notice via email or a notice on the Services.
